Minimum Wage Increases
January 1, 2022
This chart covers January 1, 2022, minimum wage increases for all applicable states and some larger U.S. cities. Some states and localities increase their minimum wage rates mid-year or on a different cycle. The information in the chart applies to January 1, 2022 increases only (Note: New York increases their minimum wage on December 31). Localities that are changing their minimum wages on a different cycle are included in the bottom portion of the calendar.
Note: This is not an exhaustive list and there may be additional local jurisdictions that have scheduled increases. Check your local laws to confirm compliance.

Federal
December 1, 2021
- IRS provides guidance on the end of the employee retention tax credit (ERTC). The Internal Revenue Service (IRS) has issued guidance on the retroactive termination of the ERTC.
- IRS proposes Affordable Care Act reporting relief and deadline extensions. The IRS has issued a proposed regulation that provides reporting relief and extends deadlines under the ACA.
December 28, 2021
- DOL amends rules for tipped employees. The U.S. Department of Labor (DOL) has issued a final rule that limits the amount of time tipped employees can perform work that isn't "tip-producing work" and still be paid at a reduced cash wage under the Fair Labor Standards Act.
January 14, 2022
- DOL issues 2022 adjusted penalty amounts. The DOL has announced the 2022 annual adjustments to the civil monetary penalties for a wide variety of benefit-related violations.
January 30, 2022
- DOL issues a final rule implementing minimum wage increase for federal contractors. The Biden administration has announced a Final Rule that directs federal contractors to pay workers a $15 minimum and provides additional enforcement and worker protections.
Arizona
April 1, 2022
- Tucson, AZ increases minimum wage. The city's minimum wage increases to $13 per hour and the minimum cash wage for tipped employees increase to $10.00 per hour.
California
December 15, 2021
- West Hollywood requires paid and unpaid leave. West Hollywood has enacted an ordinance that requires employers to provide paid and unpaid leave benefits to hotel workers.
January 1, 2022
- California phases out the subminimum wage for workers with disabilities. California phases out a provision that allows employers to pay a subminimum wage to employees with disabilities.
- California raises minimum pay requirements for certain overtime exemptions. Computer software employees must earn at least $50 per hour (for all hours worked); a monthly salary of $8,679.16; or an annual salary of $104,149.81. Licensed physicians and surgeons are required to earn an hourly wage of at least $91.07.
- California prohibits piece-rate pay for garment workers. California prohibits employers from paying garment workers by piece-rate and has released frequently asked questions that address proper payment and responsibilities under the Garment Worker Protection Act.
- California extends recordkeeping period. California extends the minimum recordkeeping period to four years for records retained under its nondiscrimination law.
April 1, 2022
- California sets new deadline for pay-data reporting. California employers with 100 or more employees must report pay and other data to the Department of Fair Employment and Housing.
Colorado
January 1, 2022
- Colorado paid sick leave law now applies to smaller employers. Colorado extends its paid sick leave requirements to employers with 15 or fewer employees.
- Colorado clarifies rules on unused paid time off. Colorado has issued a final rule that clarifies that employers are prohibited from requiring employees to forfeit any accrued paid time off.
- Colorado finalizes new pay and poster rules. The state has released rules which increase the minimum salary required for exemption from overtime, add a new exemption from overtime for highly compensated employees, and establish new poster rules for employers.
Connecticut
January 1, 2022
- Connecticut expands FMLA. Connecticut's Family and Medical Leave law expands to cover all private sector employers and include other changes. The state's new paid family leave program will also provide wage-replacement benefits to employees who take leave for covered reasons.
Delaware
December 29, 2021
- Delaware repeals youth and training minimum wages. Delaware repeals a provision that allows employers to pay less than the minimum wage to youth workers and new employees.
Illinois
January 1, 2022
- Illinois clarifies protections against disability discrimination. Illinois expressly prohibits employers from discriminating against applicants and employees because of their association with an individual who has a disability.
- Illinois expands its leave requirements. Illinois expands leave requirements and other protections under the Victims' Economic Security and Safety Act.
- Illinois expands secure choice requirements. All employers with five or more employees in the state during every quarter of the previous calendar year must register with Illinois Secure Choice and follow the employer requirements if they don't offer a qualifying retirement plan.
- Illinois adds reporting requirements for employers using AI for video interviews. Illinois requires employers to collect and report certain demographic data to the state if they rely solely upon an artificial intelligence analysis of a video interview to determine whether an applicant will be selected for an in-person interview.
Maryland
April 1, 2022
- Howard County establishes minimum wage. The County set the minimum wage to $14 per hour for employers with 15 or more employees, and $12.50 per hour for employers with less than 15 employees.
Massachusetts
January 1, 2022
- Massachusetts continues to phase out premium pay rule. Retail establishments with more than seven employees, including the owner, must pay at least 1.1 times an employee's regular rate of pay (down from 1.2 in 2020) for work on Sundays, Memorial Day, Juneteenth, Independence Day, and Labor Day. The (1.1) rate will also apply to all retail establishments for work performed on New Year's Day, Columbus Day, and Veterans Day.
Maine
January 1, 2022
- Maine increases the minimum salary required for overtime exemption. The minimum salary requirement for administrative, professional, and executive exemptions increases to $735.59 per week.
- Maine narrows who qualifies for tip credits. Maine increases the amount in tips an employee must receive to be considered a service employee that qualifies for the tip credit under its laws.
Minnesota
January 1, 2022
- Minnesota expands pregnancy and lactation accommodation laws. Minnesota extends reasonable accommodations related to pregnancy or childbirth to employers with 15 or more employees and prohibits employers from reducing an employee's pay for the time used to express milk (effectively requiring paid lactation breaks).
New Hampshire
- Medical marijuana may be a reasonable accommodation in New Hampshire. The New Hampshire Supreme Court has ruled that an employee may be entitled to use medical marijuana as an accommodation under the New Hampshire Law Against Discrimination.
New Jersey
April 19, 2022
- New Jersey limits employer vehicle tracking. New Jersey employers must provide written notice to employees before knowingly using a device that is solely designed or intended to track a vehicle, person, or device.
New Mexico
March 1, 2022
- City of Santa Fe increases minimum wage. The City of Santa Fe increases its minimum wage to $12.95 per hour.
- Santa Fe County increases minimum wage. Santa Fe County's minimum wage increases to $12.95 per hour for businesses located throughout Santa Fe County, outside of the incorporated boundaries of the City of Santa Fe, City of Española and the Town of Edgewood.
New York
December 22, 2021
- New York Issues final rule on sick leave requirements. New York issues a final rule to clarify definitions, accrual, documentation protocol, and employee counts for the purpose of sick leave.
December 31, 2021
- New York State adds protections for domestic workers. New York adds domestic workers to the definition of "employees," grant them the protections afforded to employees under the law and prohibit employers from retaliating against them for opposing any unlawful practices under the law or because the worker has filed a complaint.
- New York increases the minimum salary required for overtime exemption. The minimum salary requirement for executive and administrative exemptions for Nassau, Suffolk, and Westchester counties increases to $1,125 per week. For any other part of the state, except New York City, the minimum salary requirement increases to $990 per week. For New York City, the minimum salary requirement for these exemptions remains $1,125 per week.

- New York extends paid family leave protections. New York expands the definition of "family member" under the NY Paid Family Leave law to include siblings.
January 26, 2022
- New York expands whistleblower protections. New York extends protections for whistleblowers, former employees, and independent contractors and expands the scope of protected activities.
March 12, 2022
- New York City adds protections for domestic workers. New York City requires all employers with one or more domestic workers to provide nondiscrimination protections and prohibit sexual harassment from employers, family members and others in a household.
Oregon
January 1, 2022
- Oregon prohibits driver's license discrimination. Oregon prohibits employers from requiring an employee or prospective employee to possess or present a valid driver's license as a condition of employment or continued employment.
- Oregon bans hairstyle discrimination. Oregon expressly prohibits employers from discriminating against an employee on the basis of physical characteristics that are historically associated with race, such as natural hair, hair texture, hair type and protective hairstyles.
- Oregon amends Family Leave Act. Oregon amends the Oregon Family Leave Act to allow covered employees to take childcare leave during a public emergency.
Pennsylvania
December 15, 2021
- Allegheny County, PA announces paid sick leave effective date. Allegheny County requires employers with 26 or more employees to provide paid sick leave to employees who work in the county.
Washington
January 1, 2022
- Washington increases the minimum salary required for overtime exemption. The minimum salary requirement for the administrative, professional, and executive exemptions from overtime increases to $1,014.30 per week.
