Fall 2022 HR Compliance Calendar

Below is a summary of compliance requirements that took effect recently or will take effect soon.

Minimum wage increases

The minimum wage chart and lists below are not exhaustive. There may be additional state and local jurisdictions that have scheduled increases or additional employees (EEs) that are impacted. Check your applicable laws to confirm compliance.

Minimum wage increases occurring before January 1, 2023

The list below covers minimum wage changes occurring before January 1, 2023.

Florida

  • Florida's minimum wage will increase to $11.00 per hour and the tipped minimum wage will increase to $7.98 per hour on September 30, 2022.

Hawaii

  • Hawaii's minimum wage will increase to $12.00 per hour and the tipped minimum wage will increase to $11.00 per hour on October 1, 2022.

Houston, Texas

  • Houston, Texas airport workers' minimum wage will increase to $14.00 per hour on October 1, 2022.

New York (other than NYC, Nassau, Suffolk and Westchester Counties)

  • New York jurisdictions, other than New York City, Nassau, Suffolk and Westchester Counties, are scheduled to increase their minimum wage to $14.20 on December 31, 2022. The tipped minimum wage for service employees and food service workers will increase to $11.85 and $9.45, respectively.

Minimum wage increases set for January 1, 2023

The chart below applies only to states and larger U.S. cities that will increase their minimum wage on January 1, 2023. Many jurisdictions have not announced their scheduled minimum wage increase and are noted as to be determined (TBD). Check the government sites that apply to your jurisdiction over the upcoming months to help ensure compliance with changing minimum wage rates.

*Tip Credits are prohibited under state law. The tipped wage equals the minimum wage.

**The Michigan Court of Claims has ruled that the legislature violated the state's Constitution when it adopted and then amended ballot initiatives to increase the minimum wage. If left standing, the ruling means the original versions of those laws would apply and the minimum wage could increase to $12.00 per hour.

  

Federal updates

Federal

October 31, 2022

  • DHS extends a policy allowing remote inspection of Form I-9s. The Department of Homeland Security extended the remote inspection of Form I-9s in certain situations related to COVID-19 until October 31, 2022.

December 31, 2022

  • Student loan relief is extended. President Joe Biden announced an extension of the pause on student loan repayment through December 31, 2022, along with a plan to forgive certain federal student loan debt.

State updates

Alabama

January 1, 2023

  • Alabama amends law on firearms in employer parking lots. Alabama has amended the conditions under which employees are entitled to keep firearms in their cars while in their employer's parking lot.

California

October 1, 2022

  • San Francisco voters approve paid public health emergency leave. A ballot initiative (Proposition G) will require certain employers to provide paid leave to employees for public health emergencies.

January 1, 2023

  • California increases the minimum salary required for overtime exemptions. The minimum salary requirement for the administrative, professional and executive exemptions will increase to $1,240 per week.

Colorado

January 1, 2023

  • Colorado increases the minimum salary required for overtime exemption. The minimum salary requirements for the executive/supervisor, administrative and professional exemptions from overtime will increase to $961.54 per week.
  • Colorado enforces wage protections. Colorado will significantly change its enforcement procedures and penalties for employers that fail to pay employees' current and past-due wages.
  • Colorado Voters Approve Paid Family and Medical Leave Program. Contributions to the family and medical leave program funded by employers and employees will begin in 2023.

Illinois

January 1, 2023

  • Illinois expands bereavement leave law. Illinois will expand the circumstances that an employer with 50 or more employees must provide unpaid bereavement leave.
  • Illinois amends rules for day of rest and meal periods. The state has modified the hours of rest rules and made changes to meal break requirements.
  • Illinois prohibits hairstyle discrimination. Employers are expressly prohibited from discriminating against individuals based on the employee’s hair texture or protective hairstyle.

Maine

January 1, 2023

  • Maine narrows who qualifies for tip credits. Maine will increase the amount in tips an employee must receive to be considered a service employee that qualifies for the tip credit under state law.
  • Maine requires employers to pay out unused paid vacation. Maine will require employers to pay out all accrued, unused vacation at the time of separation.

Massachusetts

October 24, 2022

  • Massachusetts bans hairstyle discrimination. Massachusetts expressly prohibits discrimination against individuals based on traits associated with race, such as hair texture, hair type, hair length and protective hairstyles.

New York

September 1, 2022

  • Ithaca enacts salary transparency law. Ithaca employers with four or more employees must disclose the minimum and maximum hourly or salary compensation for an employment opportunity, such as a job, promotion, or transfer opportunity, in job postings.

November 1, 2022

  • New York City enacts salary transparency law. The New York City commission on human rights has released additional guidance on its pay transparency law.

November 6, 2022

  • Westchester County enacts salary transparency law. Westchester County employers will be prohibited from advertising a job, promotion or transfer opportunity without also including the minimum and maximum salary for the job, promotion, or transfer in the job posting or advertisement.

January 1, 2023

  • New York extends paid family leave protections. New York will expand the definition of "family member" under the New York Paid Family Leave law to include siblings.
  • NYC limits the use of automated tools in employment decisions. New York City has amended its Human Rights Law and will regulate the use of automated tools in certain employment decisions.

Oregon

September 28, 2022

  • Oregon temporarily amends Equal Pay Act. Oregon's temporary redefining of compensation under the state Equal Pay Act is scheduled to end on September 28, 2022.

January 1, 2023

  • Oregon adopts paid leave program. Oregon will provide eligible employees with wage-replacement benefits for family and medical leave.

Pennsylvania

December 31, 2022

  • Philadelphia enacts commuter transit benefits requirement. Covered employers in Philadelphia with 50 or more employees must provide employees with a commuter transit benefit program.

Rhode Island

January 1, 2023

  • Rhode Island enacts wage protections. Rhode Island will ban salary-history inquiries and add pay-equity requirements.

Washington

January 1, 2023

  • Washington enacts salary transparency requirements. Washington has amended its Equal Pay and Opportunities Act to add new salary transparency requirements.
